Limitation of Liability and Takedown Policy

The CEF AT Catalogue of Services content and metadata are provided “AS IS” and on an “ΑS AVAILABLE” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-­infringement, compatibility, security and accuracy.

Under no circumstances will the Catalogue be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of opportunity; (c) loss of goodwill or injury to reputation; (d) losses suffered by third parties; or (e) any indirect, consequential, special or exemplary damages arising from the use of the Catalogue services regardless of the form of action.

CEF AT Tools and Services does not warrant that functions contained in the Catalogue Services will be uninterrupted or error free, that defects will be corrected, or that the Catalogue databases or the delivery mechanism that make it available are free of viruses and bugs.

CEF AT Tools and Services does not warrant that the list of third-party tools or services recorded in the Catalogue will be complete and exhaustive. Providers of LT tools/services who are not yet listed in the Catalogue are requested to contact DGT-ETRANSLATION-ADVISORY[at]ec.europa.eu or fill in this form. Depending on the relevance of their tool/service to the Catalogue scope and objectives, the Catalogue will be updated accordingly.

If a provider/developer/rights holder of a tool or service listed in the Catalogue is concerned that s/he has found a tool/service description on the Catalogue, which s/he requires to be excluded from the Catalogue records or s/he has found inaccurate or incomplete, such provider/developer/rights holder is asked to contact CEF AT Tools and Services (DGT-ETRANSLATION-ADVISORY[at]ec.europa.eu) in writing, stating the following:

  1. His/Her contact details (name, organisation, email, telephone number);
  2. The tool/service name and the exact and full URL where s/he found the tool/service description;
  3. Proof that s/he is the rights holder and a statement that, under penalty of perjury, s/he is the rights holder or an authorised representative.

Upon receipt of notification the Notice and Takedown procedure is then invoked as follows:

  1. CEF AT Tools and Services will acknowledge receipt of the complaint by email or letter and will make an initial assessment of its validity and plausibility.
  2. Upon receipt of a valid complaint, the tool/service record will be temporarily removed from the Catalogue pending an agreed solution.
  3. CEF AT Tools and Services will contact the individual or organisation who filed the complaint within ten working days from the reception of a valid complaint. The complainant and the CEF AT Tools and Services will resolve the issue swiftly and amicably and to the satisfaction of both parties, with the following possible outcomes:
    • The tools/service record is replaced on the Catalogue with changes.
    • The tools/service record is permanently removed from the Catalogue.
